Terms & Conditions
Last updated: October 28, 2026
These Terms & Conditions (the "Terms") govern the use of all the services provided by TRAVEL MONEY SAS, a simplified joint-stock company (société par actions simplifiée) incorporated under French law, with share capital of €3,000, RCS Paris 932 697 022, registered office at 14 Rue Charles V, 75004 Paris, France, intra-community VAT number FR75 932 697 022, operating under the trade name "Privé" (nom commercial) (the "Company" or "Privé"). Travel Money Inc., a Delaware corporation, is the US parent company of Travel Money SAS and is not a party to these Terms.
By using any Privé platform or service, including mobile applications, website, browser extensions, Cami (Privé's AI shopping assistant), or any related software, product or service (together, the "Platform"), you (the "Customer") acknowledge that you have read, understood, and accepted these Terms. Cami, Privé's AI shopping assistant, is governed by the Cami Terms of Service, which are specific service terms under Section 19.
1. Purpose and Scope
Privé operates a concierge purchasing service (the "Privé Concierge" or "PC") providing the following activities:
(a) Purchasing and Export-Resale Services: Under a resale agreement, Travel Money SAS buys goods from the brand or boutique and resells them to Customers at VAT-exempt export prices, with delivery to the Customer's address outside the European Union, including the United States. This activity is carried out in accordance with French tax ruling Rescrit RI n° 2026-19 and includes managing export process, documentation, customs formalities, shipping, and any applicable import fees or tariffs.
Access to the PC purchasing services requires a free Privé account (see Section 3). There is no membership, subscription or account fee. You pay only for the Goods you order and the charges shown at checkout.
2. Definitions
For the purposes of these Terms:
"Goods" means physical, non-consumable goods that Privé acquires from retailers and merchants and resells to the Customer, with a view to export and delivery outside the European Union.
"Account" means the free Privé account you create to use the Platform and place orders.
"Service Fee" or "Commission" means Privé's remuneration for providing purchasing, logistics, export and concierge services. It is included in the Privé price shown at checkout and shown as a separate line on your invoice where the law requires.
"Export Delivery" means the shipment and delivery of Goods to your designated address outside the European Union, qualifying as an export exempt from French VAT pursuant to Article 262-I of the French Tax Code.
"Referral Program" means the rewards program through which Customers can earn credits by referring new customers to the Service.
3. Your Privé Account
3.1 A free account
You need a Privé Account to place orders. Creating and keeping an Account is free. There is no membership, subscription or account fee, and using Cami, Privé's AI shopping assistant, is free on every channel, including inside AI assistants that connect to Cami (see the Cami Terms). You pay only for the Goods you order, at the price shown at checkout.
Cami is an AI, not a person, and can make mistakes. Check details at checkout. How Cami works.
3.2 Who can open an Account
You must be at least 18 years old, or the age of majority where you live if higher, to open an Account or place an order. When you sign up, you confirm that you meet this requirement. See also Section 5.
3.3 One Account per person
Accounts are personal and may not be shared, sold or transferred.
3.4 Account security
You are responsible for keeping your login credentials confidential and for all activity under your Account. Tell us immediately at support@withprive.com if you suspect unauthorized access.
3.5 Closing your Account
You can close your Account at any time by emailing support@withprive.com. Closing your Account does not cancel an order that Privé has already purchased; Section 13 applies to those orders.
3.6 Former paid memberships
Privé no longer sells paid memberships. If you signed up for a membership before November 1, 2026, email support@withprive.com. That is how we handle a former membership. Referral credits you have already earned stay valid as set out in the Referral Program Terms.
4. Referral Program
4.1 Overview
The Referral Program allows existing Customers to earn rewards by referring new customers to Privé.
4.2 Referrer Rewards
For each successful referral (defined as a referred individual whose first order is delivered and not returned), the referring Customer receives a $100 credit applied to their Privé account. Additional milestone bonuses and spend-based bonus layers may be available as described on our website.
4.3 Referee Benefits
New customers who sign up through a valid referral link receive a $50 credit towards their first order.
4.4 Program Rules
- Referral credits are non-transferable and have no cash value.
- Self-referrals are prohibited.
- Privé reserves the right to void credits obtained through fraud, manipulation, or violation of these Terms.
- The Company may modify, suspend, or terminate the Referral Program at any time with reasonable notice.
- Referral rewards may be subject to applicable tax reporting requirements.
The complete referral program terms and conditions are available at www.withprive.com.
5. Customer Eligibility
The Privé Concierge services are strictly reserved for customers who are:
- established and residing outside the European Union;
- acting as final consumers purchasing for personal use;
- requesting delivery of Goods outside the European Union; and
- holding a Privé Account in good standing.
Privé may request any information or documentation necessary to verify eligibility.
6. Legal Nature of the Service
When you engage Privé Concierge services, the following legal relationship applies:
(a) Resale: Travel Money SAS buys the Goods from the brand or boutique and resells them to you. You pay Travel Money SAS. Privé does not buy as your agent, and you do not pay the merchant. The resale is an export sale exempt from French VAT. A resale invoice is issued by Privé in your name.
(b) Logistics Coordination: Privé arranges for the physical export and delivery of Goods to your designated address outside the European Union, including customs formalities via the electronic export declaration system.
(c) Price Structure: The Privé price shown at checkout includes the purchase price of the Goods (excluding VAT), Privé's Commission, a shipping estimate and an import-duties estimate. There is no separate account or membership fee.
7. How the Service Works
7.1 Service Request
You submit a request through the Platform specifying the Goods you wish to purchase. Travel Money SAS buys those Goods from the brand or boutique and resells them to you. You pay Travel Money SAS. Orders are subject to any minimum order value shown at checkout and to delivery to an eligible address in the United States.
7.2 Purchase and resale
You pay Travel Money SAS. Travel Money SAS buys the Goods from the brand or boutique and resells them to you at the VAT-exempt export price. Privé invoices you for the product price (excluding VAT), its Commission, shipping, and applicable duties or taxes, and arranges export and delivery to your address outside the EU. Any amount you have already paid is offset against the final invoice, with any remaining balance settled between you and Privé. The Commission is included in the Privé price shown at checkout.
7.3 Payment Structure
You will be invoiced by Privé for:
- Product purchase price (excluding VAT)
- Service Fee / Commission
- Shipping and logistics costs
- Insurance costs
- Foreign customs duties and taxes included in the invoice
7.4 Pricing Disclaimer
All prices, rates, savings percentages, savings estimates, and product examples displayed on the Platform, in marketing materials, social media, emails, advertisements, Cami, or any other communication channel are indicative and subject to change at any time without notice. Any savings claim, savings percentage, or savings amount represents the difference between the Privé price for an item and the price of the same item in the Customer's home country, as identified by Privé at the time of publication. Because home-country prices vary by retailer, market, currency, local taxes, and time, your actual savings will depend on the comparison price applicable to you and may differ from any figure shown. Savings percentages shown in the product interface, on the website, in promotional materials, or in any other context (for example, "save up to 30%" or similar claims) are estimates based on conditions at the time of publication and are not guaranteed. Changes may result from, but are not limited to: fluctuations in foreign exchange rates, changes in retail pricing by merchants or brands, changes in applicable VAT rates or customs duties, changes in shipping or logistics costs, product availability, differences in the home-country comparison price, or corrections of errors.
The estimated Privé price (including any estimate of shipping, duties and tariffs), comparisons with a US retail price, sales-tax estimates, and bag links are estimates and informational only. A bag link adds items to your bag. It does not charge you, hold stock or lock a price, and it may expire. Privé does not add US sales tax to the Privé price. Your state may treat a purchase as subject to use tax. The final price is the price shown at checkout, which you review before you pay.
The final price and actual savings payable by the Customer will be confirmed at the time of checkout. Privé does not guarantee that any price, rate, savings percentage, or savings estimate shown at any point prior to checkout will remain available. Any product examples referenced in marketing (for example, specific handbag models or brand items at specific prices or savings levels) are illustrative only and do not constitute a binding offer at any stated price or savings rate.
7.5 VAT Treatment and Export Exemption
VAT Deduction: Privé deducts VAT paid on purchases from French merchants in accordance with Article 271 of the French Tax Code and the confirmation in Rescrit RI n° 2026-19.
Export Exemption: The resale of Goods to you outside the European Union constitutes an export exempt from French VAT pursuant to Article 262 I 1° of the French Tax Code.
Commission Exemption: The Service Fee (Commission) charged to you as a non-EU resident is exempt from VAT as a service directly related to an export, in accordance with Articles 262 I 1° and 257 ter of the French Tax Code.
Ancillary Services: Transport costs, insurance, and customs duties invoiced to you are likewise VAT-exempt as services ancillary to the main export operation.
Privé does not provide a direct VAT refund to you. VAT savings result from the export exemption mechanism and are incorporated into the pricing structure.
8. Export Logistics and Proof of Export
Privé coordinates the transport and export formalities through professional express freight companies. The freight company receives the Goods at its logistics warehouse in France, handles French customs export declarations via the Delt@ electronic system, and ensures physical delivery to the Customer's address outside the EU. Privé retains the electronic export declaration (Delta certification bearing the mention "Sortie") as proof of export for VAT purposes.
9. Customer Obligations
You undertake to:
- Provide accurate and complete information regarding your eligibility, orders, and delivery details.
- Keep your Account information accurate and up to date.
- Comply with all payment obligations in a timely manner.
- Ensure that your use of the services complies with all applicable tax, customs, and import/export regulations in your jurisdiction.
- Refrain from any use of the services that would violate these Terms or applicable laws.
- Not use the Referral Program in a fraudulent or manipulative manner.
10. Brand Policies and Restrictions
Many luxury brands maintain policies restricting unauthorized resale of their products. Privé's purchasing operations are structured to comply with applicable brand policies and distribution agreements. You acknowledge that you are purchasing Goods for personal use and not for commercial resale. Privé reserves the right to decline service requests that may violate brand policies, trademark rights, or applicable laws.
11. Liability
11.1 Legal guarantee
As the seller of the Goods, Travel Money SAS is responsible to you for their conformity with the contract under the legal guarantee of conformity (French Consumer Code, Articles L.217-3 and following: two years from delivery) and for hidden defects (French Civil Code, Articles 1641 and following), in addition to any manufacturer's warranty. Contact support@withprive.com about a defect.
11.2 Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control (Section 12), or for import restrictions of your destination country that we told you about before you ordered.
11.3 Liability that cannot be limited
Nothing in these Terms excludes or limits our liability where the law does not allow it.
12. Force Majeure
Privé shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond Privé's reasonable control. Such circumstances include, but are not limited to: natural disasters, epidemics, pandemics, acts of war or terrorism, civil unrest, government actions or sanctions, trade embargoes, changes in applicable law or regulation, customs authority actions or delays, carrier or logistics disruptions, merchant or brand supply interruptions, labor disputes, power or telecommunications failures, cyberattacks, and disruptions to banking or payment systems.
In the event of a force majeure event, Privé will use reasonable efforts to notify affected Customers promptly and to resume performance as soon as practicable. If a force majeure event continues for more than 60 days, either party may terminate the affected order or service request without liability, and Privé will refund any amounts paid for Goods not yet delivered.
13. Cancellation and Returns
13.1 Closing your Account
You may close your Account at any time (Section 3.5). There are no account fees to refund.
13.2 Former paid memberships
If you signed up for a membership before November 1, 2026, email support@withprive.com. Section 3.6 applies.
13.3 Suspension by Privé
Privé may suspend or close your Account for violation of these Terms, fraudulent activity, abuse of the Referral Program, or misuse of the Service. Outstanding referral credits will be forfeited upon termination for cause. We will give you reasons and, except in cases of fraud or other urgency, reasonable notice.
13.4 Order Cancellation
You may cancel a service request before Privé has completed the purchase. Cancellation fees may apply if costs have already been incurred.
13.5 Returns
Privé delivers to customers outside the EU (in the United States). We do not accept a return because you changed your mind. Returns are accepted only when Goods are defective, damaged during shipping, or materially different from the description. Contact support@withprive.com. The legal guarantee in Section 11.1 applies to a defect.
14. Intellectual Property
All intellectual property rights in the Platform, including trademarks, logos, and content, belong to Privé or its licensors. You may not use Privé's intellectual property without prior written consent.
15. Data Protection and Privacy
Privé processes your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for detailed information on data collection, use, and your rights.
16. Governing Law and Jurisdiction
16.1 Governing law
These Terms are governed by French law. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of the country (or US state) where you habitually live. Where that law protects you more, it applies (Article 6 of Regulation (EC) No 593/2008, "Rome I").
16.2 Courts
If you are a consumer, you may bring proceedings in the courts of the place where you live or in the competent courts of Paris, France, and we will bring proceedings against you only in the courts of the place where you live. You may also use a small-claims procedure where you live if one is available. If you act for business purposes, the courts of Paris, France have exclusive jurisdiction.
17. Dispute Resolution
17.1 Informal resolution
Before filing any formal legal action, you agree to first attempt to resolve any dispute by emailing support@withprive.com (subject "Complaint"). We will work in good faith to resolve the matter within 30 days.
17.2 Consumer mediation
If we cannot resolve a complaint you sent us in writing, you may refer an unresolved written complaint to a consumer mediator; contact support@withprive.com for details. Mediation under Articles L.612-1 and following of the French Consumer Code is free and voluntary, and you may still go to court as set out in Section 16.2.
17.3 No forced arbitration
Nothing in these Terms requires you to arbitrate a dispute or prevents you from bringing or joining a claim in court as the law allows. After a dispute has arisen, you and Privé may agree in writing to settle it by arbitration, but you are never obliged to.
18. Amendments
Privé may update these Terms from time to time. The version in force is the one published on the Platform. Material changes will be notified to Customers by email at least 30 days before taking effect. Continued use of the services after any amendment constitutes acceptance, except where mandatory consumer law requires otherwise.
19. Severability and Entire Agreement
If any provision is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, Cookie Policy, and any specific service terms, including the Cami Terms of Service, constitute the entire agreement between you and Privé.
20. Legal Notice
Company details and our host are set out in our Legal Notice.
